TERMS AND CONDITIONS OF SALE — ACTIVESHIFT

1. General Provisions

These General Terms and Conditions of Sale apply to the purchase of products made remotely through the ActiveShift website (hereinafter "Website"), managed and owned by Marco Tondi (hereinafter "Owner").

Purchases made on the Website are governed by these conditions and by the current legislation on e-commerce and distance contracts.

3. Products and Prices

• All prices displayed on the Website are in Euro (€) and are inclusive of VAT (where applicable), unless otherwise specified.

• Shipping costs are included in the product's purchase price; customs duties, where applicable, are excluded. 

• The images and descriptions of the products on the Website are indicative; small variations in color or packaging do not constitute a lack of conformity.

4. Orders and Conclusion of Contract

• The customer's submission of an order constitutes a contractual purchase proposal.

• The contract is considered concluded when the Customer receives the Order Confirmation via email to the address provided during checkout.

• The Owner reserves the right to refuse or cancel orders in case of product unavailability, pricing errors, or suspected fraud.

5. Payment Methods

ActiveShift accepts the following secure payment methods:

• Credit/Debit Cards (Visa, Mastercard, Maestro, etc.)

• PayPal

• Bank Transfer 

Payment is charged at the time the order is placed. The customer's financial data is processed directly by payment service providers using secure encryption protocols.

6. Shipping and Delivery

• Products are shipped to the address indicated by the Customer during the order process via express courier.

• Standard processing and delivery times are approximately [e.g., 24-72 hours / 3-5 business days] from order confirmation.

• ActiveShift is not responsible for any delays directly attributable to shipping/courier services or to force majeure events.

7. Right of Withdrawal (14 Days)

According to consumer protection regulations:

• The Customer has the right to withdraw from the contract, without stating any reason, within 14 days from the physical receipt of the products.

• To exercise the right of withdrawal, the Customer must send a written communication to marcotondi2002@gmail.com

• Products must be returned intact, unused, unwashed, with original tags, and in their original packaging.

• Shipping costs for the return are at the customer's expense.
  The refund will be issued within 14 days of receiving and verifying the returned goods, using the same payment method chosen during the purchase.

8. Legal Guarantee of Conformity

• All products sold on ActiveShift are covered by the Legal Guarantee of Conformity for 24 months (for purchases made by private consumers).

• In case of a defective or non-conforming product, the Customer is entitled to repair, replacement, or refund of the product, subject to verification by the Owner.

9. Limitation of Liability

ActiveShift will not be liable for indirect damages, loss of data, or service disruptions resulting from the use of the Website or internet network malfunction, except in cases of willful misconduct or gross negligence.

10. Privacy and Data Processing

Personal data provided by the Customer will be processed in compliance with the General Data Protection Regulation (GDPR - EU 2016/679). For more details on data usage, please consult the Privacy Policy section of the Website.

11. Applicable Law and Competent Court

These General Conditions are governed by Italian law. For any dispute regarding the validity, interpretation, or execution of the contract, the Court of the consumer's place of residence or domicile shall have jurisdiction.
